Spain’s 90 day rule – is it about to change?

Since Brexit, this controversial EU regulation has meant that – as a UK national – you can only spend up to 90 days (within a total period of 180 days) in any EU member country. British citizens no longer have the same freedom of movement, and to stay long-term in Spain, you now need a visa.

Whilst Brits have retained the same right to purchase a property in Spain, the 90 day rule has limited how long they can stay there for. Naturally this has discouraged some people from taking the leap and making their dream of a home under the Mediterranean sun a reality.

Sound familiar? Well, what if we said things may be about to change?

Following France’s recent decision to amend immigration law for British second homeowners, the Spanish government have now joined calls to axe this unpopular regulation, appearing more determined than ever to lift Spain’s 90 day rule for UK nationals.

France – leading the revolution for British homeowners

Last month, the French Senate approved a bill amendment which grants automatic long-stay visa rights to British second homeowners in France, ‘without the need for any formalities’.

The amendment recognises the unique circumstances of British part-year residents who own properties in France. Many of them didn’t vote for Brexit and find themselves in this unfortunate situation – restricted by the Schengen 90 day rule – through no fault of their own.

The aim, therefore, is to help those being ‘punished by Brexit’, by simplifying (or even eliminating entirely) the visa process for British homeowners and allowing them easier, extended stays.

The amendment will proceed to the Assemblée Nationale for debate in December. If it’s approved, it will mean that second homeowners in France will gain automatic right to a visa (which seems to amount to a visa exemption), and would only need to worry about the 90/180 regulation issue when visiting EU countries outside of France.

So what does this mean for Spain?

It seems the Spanish government are attempting to follow in France’s footsteps.

The 90 day rule isn’t something that Spain established (or even supported). In recent months, the government has revealed how the restriction has actually worked against the country’s interests, having a significant negative impact on the Spanish economy. With this in mind, Spain is now joining France in its efforts to scrap the 90 day rule for UK nationals.

According to Spain’s acting Minister of Tourism, Hector Gomez, it’s in Spain’s ‘interest to lobby and convince the EU that it can try to work an exception with them’. Gomez also confirmed that he had held an ‘important meeting’ with the UK’s Director of Consular Affairs and Crisis at the Foreign Office, in which the interest of Brits in Spain and the Schengen 90 day rule was discussed.

This initiative is a clear sign of Spain’s commitment to improve the situation, both for current British homeowners and those eager to invest in property in the future. Underscoring the value of British residents and perhaps signifying a new chapter in the relationship between the two countries.
