Can you rent out your property in Marbella?
In short, yes, you can. However, there are a few rules you must meet, and it depends on whether you’re seeking short-term rentals or long-term rentals.
Short-term rentals in Marbella
For homeowners in Marbella, a short-term holiday rental is the most common choice. It’s also the most regulated, especially if your property is in a building with a Community of Owners.
As of 2025, renting out your property in Marbella involves meeting the following requirements:
- The Community Veto – The most crucial step for apartments. If your property is in a homeowners’ association (otherwise known as an HOA), you must obtain a majority vote from other owners to approve new tourist rental activity. Failure to get these votes means you cannot rent out your Spanish property. The good news is that if you already had a tourist rental license (VUT) before April 3rd 2025, you should be protected from any vote.
- Double registration – To rent out your Marbella property, you need two types of registrations: the Vivienda de Uso Turístico license from Andalucía, and a new National Registry (NRA) number – mandatory from July 2025.
- Strict standards – Your property has to meet higher quality and safety requirements to be eligible for rental. This includes mandatory air conditioning and heating systems, specific space per guest (14 sqm), and the correct number of bathrooms.
Long-term rentals in Marbella
From a licensing point of view, long-term rentals are easier to manage. However, property owners are subject to the national Urban Leases Law (LAU), which heavily protects the tenant.
There are three key aspects of long-term rental in Marbella you must be aware of. The first is that no community vote is required for long-term residential lease agreements.
The other two factors to consider for long-term rentals are:
- Minimum duration – If the tenant is using your property as their permanent home, the contract is governed by the LAU. The tenant has the right to extend the lease annually up to five years, even if they’ve only signed a one-year contract.
- Tax – For EU/EEA residents, long-term rentals can be more tax-efficient because you can deduct more expenses (mortgage interest, IBI, community fees) and still qualify for a 60% reduction on the net rental income.
